Fatal Car Accidents in Alabama

The sudden and unexpected loss of a loved one is incredibly difficult to deal with. Unfortunately, hundreds of people die as a result of crashes that occur in Alabama every year.

Even though the majority of states across the country follow the comparative fault doctrine when it comes to assigning fault in a motor vehicle accident, the state of Alabama is one that follows the contributory negligence law. This law states that any person who contributed to the accident taking place in any way is prevented from filing a legal claim against another person to recover compensation.

This can dramatically impact your ability to seek compensation by filing a wrongful death claim after the loss of a loved one. For this reason, it is important that you seek help from a Jefferson County wrongful death lawyer right away. Your attorney will be able to work hard to prove the four elements of negligence existed at the time of the accident and that your loved one lost their life as a result of the negligent and reckless actions of another driver.

Your attorney will be invaluable when it comes to proving your case in seeking the maximum compensation possible under state law. In Alabama, families are only able to recover punitive damages in wrongful death actions. These damages are designed specifically to punish the person who is at fault for the actions and to discourage future wrongful acts. Strong legal guidance is critical when it comes to your ability to get justice.
