Fatal Car Accidents in Alabama
In Alabama, hundreds of lives are lost every year as a result of motor vehicle accidents. There are many instances where innocent people die due to the negligent and reckless actions of other drivers. Common factors of motor vehicle accidents across our state include speeding, distractions, failing to yield, and running red lights.
When drivers are reckless and negligent in cause actions, the families of innocent victims who lose their lives in these accidents are able to pursue legal action against them. Filing a wrongful death claim can provide families with financial relief moving forward.
In order to prevail on a wrongful death claim, you must be able to demonstrate that the elements of negligence were present at the time of the crash.
First, you must show that the defendant owed a duty of care to the deceased victim. This generally means that they had a responsibility to act in a safe and reasonable manner while operating the vehicle. Next, you must show that the defendant failed to meet the expected standard of care. As a result of their failure, an accident took place that claimed the life of your loved one. Finally, you must be ever to demonstrate that your family suffered damages as a result of the accident.
Although it seems like a straightforward process, attorneys will do everything in their power to shift the blame onto the deceased victim, who is unable to defend themselves. For this reason, it is in your best interest to seek guidance from a wrongful death lawyer in Semmes as soon as possible. Your attorney will be able to help prove your case against the defendant, so your family can get justice.
